My BUSA 2106 class today!
Isn’t it weird that you may be sued in Georgia even you hit somebody in New York?
I was in my BUSA 2106 class today, and we were learning that for a state court to have Jurisdiction on a case the defendant should be either 1. resident in the state, 2. served in the state, or 3. through the long arm statute.
So, I asked the teacher about the following situation.
If a person who hit my car in New York but he is a Georgia resident, can I file the cause in Georgia even the accident happened in NY. His answer was Yes. coz its satisfied the 1.
Then I ask him what if he is a Florida resident should I file the case in FL? then he say I may file the case in FL by 1. or file the case in NY by 3. Then he added "or you may even file the case in Georgia(where I resident) by 3., since he may have to drive through GA when he go back to FL, and you have find a way to get around with it"
Well... I never know that b4... that kinda weird to me.
I am not a law expect so.... correct me if I am wrong, tho. Also, if you really need to file a lawsuit dont base on what I have said "ASK YOUR LAWYER" ^_^
